About the conference

This vital conference from The At Work Partnership examines the key legal issues affecting the responsibilities of OH professionals, enabling you to keep abreast of the implications of the Equality Act 2010, and other developments. A handpicked panel of experts will take delegates through some of the most complex and important developments in occupational health law, providing no-nonsense explanations of how they will affect OH professionals, employers and employees in practice.

One of the last actions of the previous government was the enactment of the Equality Act 2010 – a substantial piece of legislation that not only harmonised nine areas of discrimination law, but also introduced new duties that will have important implications for OH and HR professionals.

Among the changes are two new definitions of disability discrimination– indirect disability discrimination, and discrimination arising from disability – a bar on pre-employment health screening before a conditional job offer, and clarification of the definitions of direct discrimination and harassment so that they will now cover ‘associative discrimination’ and perceived discrimination. The conference includes the implications of recent case law on age discrimination.

The update on discrimination law is just one of the areas covered by this important event. OH and HR professionals will be aware of the recent guidance on confidentiality and consent from the General Medical Council, which commands transparency in the production of occupational health reports and underlines the rights of employees to withdraw their consent at any stage. OH legal expert and barrister Diana Kloss will explore this important development in her keynote address. Our health and safety law update will examine corporate killing legislation – with the first case to be heard under the Corporate Manslaughter and Corporate Homicide Act 2007 expected later this year – and criminal liability for OH consultants, and will discuss how to respond to an investigation by the HSE. The day ends with an examination of the law on work and family life, including pregnancy- related discrimination, rights to time off for parental leave and flexible working arrangements. This unique conference will provide you with a very valuable update on all of the latest OH legal developments.
