Summary:

In the first of two articles on age at work, Diana Kloss explains the implications of European law on issues such as the default retirement age, and discusses case law that seems to have muddied the water in this important area of discrimination law.

The Employment Equality (Age) Regulations 2006 brought into effect in the UK the age provisions of the European framework directive on equal treatment in employment and occupation (2000/78/EC). The Regulations will be replaced by the Equality Act 2010, probably in October 2010, and the legislation will likely be extended to ban age discrimination in the provision of goods and services…
